A ₹5,000 sale has no TDS. Two ₹6,000 sales are separate transactions, so each triggers the 1% withhold on the amount above ₹10,000. The threshold resets with each trade.
TDS is 1% of what you receive in rupees, not your gain. Sell 1 BTC at ₹2,000,000 and ₹20,000 is withheld. It applies whether you made a profit or took a loss.
If you rebalance frequently or take profits, the 1% adds up. A ₹100,000 sale costs ₹1,000 in TDS. Ten trades of that size cost ₹10,000 just in withholding.
The withheld 1% counts as a payment toward your final 30% tax liability at year end. Keep your TDS certificate from the exchange to claim it when you file.
Starting April 1, exchanges face ₹200 per day fines for not filing TDS statements with the Income Tax Department. Delays or errors trigger ₹50,000 penalties.
